1. Acceptance of Terms
By accessing or using TenantIQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. By creating an account, you represent that you have the authority to enter into these Terms on behalf of yourself or the organization you represent.
2. Description of Service
TenantIQ is an AI-powered tenant research and risk scoring platform designed for commercial real estate professionals. The Service generates reports by analyzing publicly available information using artificial intelligence, web research, and proprietary scoring algorithms. Reports may include company background, financial indicators, litigation history, credit signals, and risk scores.
3. Account Registration
To use TenantIQ, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. TenantIQ reserves the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.
4. Subscription and Billing
Paid subscriptions are billed on a recurring monthly basis through Stripe. By subscribing to a paid plan, you authorize TenantIQ to charge your designated payment method on each billing cycle. Subscriptions automatically renew at the end of each billing period unless canceled. If you cancel your subscription, you will retain access to paid features through the end of your current billing period. No refunds are provided for partial billing periods.
5. Free Tier
TenantIQ offers a free tier that includes one report per organization at no cost and with no credit card required. The free report is a lifetime allocation and does not renew. After the free report has been used, a paid subscription is required to generate additional reports.
6. Acceptable Use
You agree not to use TenantIQ to:
- Make discriminatory housing or leasing decisions based on protected characteristics including race, color, religion, sex, national origin, disability, or familial status.
- Misrepresent TenantIQ reports as legal advice, financial advice, credit reports, or professional opinions.
- Use the Service for any purpose that violates applicable local, state, national, or international law or regulation.
- Attempt to reverse-engineer, decompile, or disassemble any portion of the Service.
- Transmit any malicious code, viruses, or harmful content through the Service.
7. Disclaimer of Warranties
TenantIQ reports are generated in part by artificial intelligence systems (including large language models operated by Anthropic) applied to publicly available sources. Reports may contain inaccuracies, omissions, or out-of-date information and are provided for informational purposes only. They are not a substitute for professional due diligence, credit analysis, legal advice, financial advice, or an underwriter's independent judgment, and you should independently verify any fact material to a decision before acting on it. TenantIQ does not guarantee the accuracy, completeness, or timeliness of any information contained in reports. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, TenantIQ, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Service. In no event shall the total liability of TenantIQ exceed the amount paid by you to TenantIQ during the twelve months preceding the event giving rise to the claim.
9. FCRA Disclaimer
TenantIQ is not a consumer reporting agency as defined by the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq. Reports generated by TenantIQ do not constitute "consumer reports" as defined under the FCRA and may not be used as a factor in determining any individual's eligibility for credit, insurance, employment, or any other purpose authorized under the FCRA. TenantIQ reports analyze commercial entities using publicly available data sources only and do not access consumer credit data.
10. Data and Privacy
Your use of TenantIQ is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
11. Intellectual Property and Ownership of Research Output
Platform IP. All content, features, and functionality of TenantIQ — including without limitation text, graphics, logos, trademarks, software, source code, user interface, scoring algorithms, research workflows, prompts, model configurations, and documentation — are the exclusive property of CRELYTIC and are protected by applicable intellectual property laws.
Research output ownership. All research output generated by the Service — including composite scores, dimension scores, risk classifications, narrative analysis, executive and governance data, competitor tables, CRE footprint analysis, industry context, recommendations, underlying structured data, embeddings, and all derivatives thereof — is and shall remain the exclusive property of CRELYTIC. By submitting a company for research through the Service, you irrevocably assign to CRELYTIC any right, title, or interest you might otherwise have had in the research output, and you grant CRELYTIC a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to retain, use, reproduce, modify, analyze, combine, and create derivative works from the research output for any lawful purpose, including commercial resale as aggregated or de-identified data products.
Your Customer Use License. In exchange for your subscription fees, CRELYTIC grants your organization a non-exclusive, non-transferable, non-sublicensable license to use reports generated on your account for (a) internal business decision-making, and (b) sharing with direct business counterparties (e.g., a prospective tenant or broker) in connection with a specific prospective lease transaction. You may not resell, redistribute, syndicate, publicly publish, incorporate into a competing product, or use reports to train competing models without prior written consent from CRELYTIC.
Your inputs. You retain ownership of the inputs you type into the Service (for example, the company name and property address you submit). You grant CRELYTIC a license to use those inputs to operate the Service and to produce research output, which CRELYTIC owns under this Section.
Aggregated and derivative data products. CRELYTIC may incorporate research output into aggregated, de-identified datasets, benchmarks, indexes, time-series analytics, company intelligence caches, and similar derivative products, which CRELYTIC may license or sell to third parties. Such third parties will not be told which customer originated a given research request, and derivative products are released only at aggregation or de-identification levels designed to prevent attribution to any individual customer. This Section 11 survives termination of these Terms and of your subscription.
12. Termination
Either party may terminate the account at any time. You may cancel your account through the account settings or by contacting us. Upon termination, your right to access the Service ceases immediately at the end of any paid billing period. TenantIQ may retain your customer-facing account data for up to 90 days following termination for administrative purposes, after which it will be deleted in accordance with our Privacy Policy. Derivative intelligence data owned by CRELYTIC under Section 11 survives termination and is not deleted. TenantIQ reserves the right to suspend or terminate accounts that violate these Terms without prior notice.
13. Changes to Terms
TenantIQ reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
